AT&T to offer bigger asset sale to save T-Mobile deal: report (Reuters)

(Reuters) ? AT&T Inc is considering an offer to divest a significantly larger portion of assets than it had initially expected, in order to salvage its $39 billion deal to buy T-Mobile USA, Bloomberg reported citing a person familiar with the plan.

Bloomberg said the exact size of the divestiture hasn't been determined but reported it could be as much as 40 percent of T-Mobile USA's assets.

The divestiture is an attempt to address the concerns of the Justice Department, which sued to block the takeover on August 31 saying the deal would "substantially lessen competition" in the wireless market, Bloomberg said.

The proposed deal was dealt another blow on November 22, when the Federal Communications Commission's chairman sought to have it sent to an administrative law judge for review.

The asset-sale proposal, which could come as early as the next Justice Department hearing on November 30, might be the only remaining option if the second-largest U.S. wireless operator wants to avoid a lengthy court battle in its bid to become the country's top mobile carrier, Bloomberg said.

Yugoslavia's last PM dies aged 87 (AP)

ZAGREB, Croatia ? Croatia's state news agency says former Yugoslavia's last Prime Minister Ante Markovic has died. He was 87.

Markovic, a Croat, became Yugoslavia's prime minister in March 1989, two years before the former communist country started unraveling along ethnic lines.

Before he resigned in December 1991, Markovic tried to find a compromise between secessionists republics Slovenia, Croatia and Bosnia and Serbia which insisted that Yugoslavia remain a single entity. His efforts failed and the country plunged into a series of ethnic wars.

After the wars, Markovic, who was considered a pro-Western reformist, dedicated himself to a business career.

HINA news agency did not provide the cause of his death.

89% Martha Marcy May Marlene

Become acquainted with this name: Elizabeth Olsen. Yes, she is the sister of the Olsen twins - Mary Kate and Ashley, but I guarantee she will become this generation's Mia Farrow. Once you see the brilliant Martha Marcy May Marlene, you too will be convinced at what a great actress Elizabeth Olsen is.This is not just a great performance. This is the kind of performance that young female leads will be compared to. It's better than Charlize Theron's portrayal of Aileen Wuornos in Monster. So demanding is this role that the film's success relies almost completely on it. And that's not to say that Olsen is above the material. She has a lot to work with. The script is smart. The direction is controlled, focused, and well paced, and the tone is disturbingly bleak, chilling, and suspenseful.Horrific things happen to this character. The audience is forced to endure much of it with her, and then analyze the effects these events have on Martha's psyche. Elizabeth Olsen bares all; she completely understands her character but also forces the audience to reflect and debate on her decisions. Whatever triggered the trauma in Martha's mind has completely overtaken her being, rendering her incapable of distinguishing the past from the present and figuring out a way to move on.This is a powerful film. Elizabeth Olsen's performance is nothing short of perfect. If she doesn't win the Oscar, they may as well retire the award. The same goes for John Hawkes' portrayal of Patrick, a sinister cult leader who is every bit the antagonist to Martha. You thought he was great in Winter's Bone, but that's nothing compared to his acting here.Yes, Martha Marcy May Marlene is a must see movie because of the performances. But the acting is made even better when the material is good. In this case, the filmmaking is perfect. Thus, the performances are the best of the best, and that's within a year that has already seen Ryan Gosling, Joseph Gordon Levitt, Natalie Portman, Michelle Williams, Michael Fassbender, and Leonardo DiCaprio cement themselves as the best actors of our time.

Black Friday draws crowds but spending in doubt (Reuters)

(Reuters) ? Retailers were hoping for more shoppers like Shawn Elzia as the annual Black Friday bargain stampede marked the unofficial start of what is widely expected to be a middling holiday shopping season.

The Brooklyn, New York teacher, one of hundreds of thousands of shoppers jostling for deals around the country, said he ended up spending about 25 percent more than he planned, even while worrying about the state of the economy.

"I did not expect such deals," the 33-year old said as he left a Macy's store in Jersey City, New Jersey clutching bags full of clothing for himself and his family.

"It's slashed down to the bones," he said. "There were some great discounts if you showed up early."

Even as eager shoppers emerged from stores lugging big-screen TVs and bags full of video games and toys, it was far from certain that stretched consumers will be pulling out their wallets for much more than the best deals this year.

"Americans are still worried about jobs, still worried about the economy, they're still worried about debt of the country," said Mike Thielmann, group executive vice president at J.C. Penney.

"I don't think you can take for granted that they've got more money in their pocket or they're interested in buying this year or you can take your prices up," he said. "I don't think our economy or the consumer confidence is there yet."

(For a graphic on shopping trends see, http://link.reuters.com/tag35s)

Shopper-related injuries were popular topics on social networks such as Twitter. A shopper at a Los Angeles-area Walmart used pepper spray on a throng of shoppers and there was a shooting in a Walmart parking lot in the Oakland area.

In 2008, a security officer working at a Walmart on Black Friday was trampled to death by a crowd.

Competition among the retailers was fierce as it was among shoppers, with some stores pushing their openings and specials up to Thanksgiving night on Thursday.

The term "Black Friday" is generally accepted to refer to the time when retailers start to turn profitable for the year, although the phrase's origin is unclear.

What is clear is that while it is the busiest day of the year in terms of store traffic, it does not always mean that sales will soar for the season.

Despite brisk sales right after Thanksgiving in 2008 and 2009, total holiday season sales fell as the recession gripped the country.

The National Retail Federation, an industry trade group, expects 152 million people to hit stores this weekend, up 10.1 percent from last year.

Yet it expects sales for the full November-December holiday season to rise just 2.8 percent, well below the pace of last year when sales rose 5.2 percent.

Shares of most retailers were flat to up slightly in early trading on Friday.

LUXURY STORES BIG WINNERS

Luxury chains such as Saks Inc and those catering to lower-income shoppers, such as dollar stores, are expected to do well this shopping season. Those in the middle are expected to have a tough time winning over shoppers without the cache of the high-end set or the deep discounts others offer.

Opening early appeared to work, judging from the long lines at stores such as Toys R Us, Best Buy, Walmart and Target.

Even after a Toys R Us in New Jersey had been open for nearly an hour, at 9:50 p.m. EST on Thursday night, there was still a line of about 300 people waiting to get inside.

"It was like 'Club Toys R Us' -- one cart out, one cart in," said Charlie O'Shea, a senior retail analyst at Moody's. "People are looking for the big ticket item, which is where they're going to get the most bang for their buck."

Overall, retail executives and analysts expect a more competitive shopping season than in 2010. Unemployment remains at 9 percent, European debt woes are weighing on the stock market, and consumer confidence remains spotty.

Walmart, Gap Inc's Old Navy, and Kmart, owned by Sears Holdings, were among the few retailers open on Thanksgiving day.

Walmart began offering Black Friday deals at 10 p.m. on Thursday, while Target, electronics chain Best Buy and department store chains Macy's and Kohl's opened at midnight, their earliest starts ever.

Marta Marchado, 46, who works in construction, arrived at The Mall at Prince Georges in Hyattsville, Maryland at 4 a.m. to buy a television.

"Target has good prices," she said, almost too tired to speak as she sat on a bench in the mall courtyard. Her boyfriend was fast asleep as he leaned on her shoulder.

Other retailers, including J.C. Penney opened early Friday morning as they did last year.

Nelson Sepulveda, a building superintendent from Manhattan, was the first person in line at the Best Buy in Union Square, having queued up at 8 p.m. on Wednesday -- 28 hours before the store opened -- to get the $200 Sharp 42-inch LCD television, Play Station 3 games and other items he wanted.

This year, the heavy push by retailers got an even earlier start, as chains such as Walmart and Toys R Us started offering holiday layaway programs as early as October.

Retailers from Amazon.com to Walmart were also offering online deals as Thanksgiving has become one of the biggest online shopping days of the year.

Some shoppers, though, said they felt as if the economy was back in a recession, making them reluctant to spend.

"Because of the recession, we are not going to shop as much," said Desiree Schoolfield, 49, a public service professional from Queens, who was shopping at the Toys R Us in Times Square.

About 1,000 people were waiting in line at the midnight opening of a Target store in Farmingdale, New York.

Those midnight openings drew online petition protests from store workers, and there were shoppers too who said they did not like the early openings.

Dwayne Dickson, a 19-year-old college student who works part time at Target, decided to stand in line to try and snag some small items, such as jewelry and clothing, before his Black Friday shift began.

"I will probably accidentally spend more this year on the holidays than I did last year," said Dickson, who, as a Target employee, gets an extra 10 percent discount.

For some shoppers, staying up late beat waking up for a 4 a.m. or 5 a.m. opening. "Nobody really has to be out so early to come into the store. I really feel like that's better," Tosha Smith, a 21-year-old hotel attendant from Queens, said while shopping at Macy's in New York.

Outside, four Occupy Wall Street activists chanted "boycott Macy's" and "stop supporting big corporations" even as about 9,000 people lined up to shop at the store.

Afghan president names new central bank governor (AP)

KABUL, Afghanistan ? Afghan President Hamid Karzai has nominated a U.S.-educated banker as the new governor of the country's central bank, his spokesman said Thursday.

Presidential spokesman Hamid Elmi named the candidate as Noorullah Delawari. His nomination comes after a five month vacancy in the post caused by turmoil in Afghanistan's banking system due to the near-collapse of the Kabul Bank, once the country's largest private financial institution.

Parliament is expected to discuss its approval of the appointment on Saturday, said lawmaker Gul Pacha Majeidi.

Delawari is a former central bank governor who now sits on the institution's governing board. He will replace Abdul Qadir Fitrat, who fled to northern Virginia in late June after claiming to have received threats to his life in connection with Kabul Bank scandal.

Kabul Bank became a symbol of the country's deep-rooted corruption, and the case was closely followed by Afghans and international donors because it is widely perceived to be a test of the government's pledge to root out patronage and graft.

Afghanistan's financial system appears to be slowly recovering from the aftereffects of the near-collapse, which required a massive central bank bailout.

Last week, the IMF approved a three-year $133.6 million loan for Afghanistan because it found the government had taken steps to address governance and accountability issues that surfaced during the Kabul Bank crisis. The decision reassured international donors, many whom had withheld aid while waiting for the IMF decision.

The Kabul Bank has been split into two parts, a healthy one being run by the Afghan Finance Ministry, and another which is has taken over hundreds of millions of dollars in bad loans. The Afghan government hopes to put the healthy bank up for sale in the middle of next year.

In October, the Afghan Finance Ministry said that of the more than $800 million in fraudulent loans issued by Kabul Bank, more than $70 million has been recovered; $350 million in loans have been restructured for repayment; and $110 million in assets associated with the loans have been seized and transferred to the government.

Delawari, who is in his mid-60s, also heads the Afghan Investment Support Agency. The Afghan government set up the agency in September 2003 as a one-stop shop for investors. The agency oversees registration, licensing and promotion of new investments in Afghanistan.

Delawari left Afghanistan in the 1960s and studied in the United States and Britain. He worked at several banks in the United States, including 16 years as vice president of the multinational division of Lloyds Bank of California.

Since returning to Afghanistan in 2002, Delawari has also been an adviser to the president. He was governor of Afghanistan's central bank from November 2004 to December 2007.

Moody's warns US not to back off deficit cuts

(AP) ? Moody's Investors Services warned on Wednesday that it could downgrade the U.S. government's top credit rating, if Congress backs off $1.2 trillion in automatic deficit cuts scheduled over the next decade.

The credit rating agency said in a statement it will not lower the nation's rating on long-term debt after a special congressional panel failed this week to reach agreement on alternative cuts to the deficit.

The impasse triggered the automatic cuts, which are scheduled to kick in beginning in 2013. Moody's said any effort to reduce those cuts could force the agency to downgrade its rating.

Moody's currently has U.S. government debt with a top rating of Aaa but with a negative outlook.

The agency said it had decided to take no action based on the failure of a special congressional panel to come up with a plan because the automatic cuts will arrive at the same level of deficit reduction. Some Republicans are vowing to block the cuts slated to occur in defense programs, which amount to about half of the total.

In its statement, Moody's said, "While a change in the composition of the spending cuts would not be a major rating consideration, a reduction in the total amount ... could have negative rating implications."

Moody's did not say when it would conduct its next review of the U.S. credit rating. Fitch, another rating agency, also has a triple-A rating on U.S. debt but said in August that a failure of the congressional panel to produce a plan could lead to a reassessment of that rating. Fitch has said it will issue its next report at the end of the month.

On Monday after the announcement of the 12-member congressional panel's impasse, Standard & Poor's said it would not downgrade the U.S. credit rating. Like Moody's, it warned that its present rating was based on the expectation that the automatic cuts will not be reduced.

S&P in August cut its rating of long-term U.S. Treasury securities by one notch from AAA to AA+, the first such downgrade of U.S. government debt in history.

(AP) ? Egypt's military rulers picked a prime minister from ousted leader Hosni Mubarak's era to head the next government, according to state television, a choice that will almost certainly intensify criticism by tens of thousands of protesters accusing the generals of trying to extend the old guard and demanding they step down immediately.

Kamal el-Ganzouri, 78, served as prime minister between 1996 and 1999 and was deputy prime minister and planning minister before that. He also was a provincial governor under the late President Anwar Sadat.

"Illegitimate, illegitimate!" chanted the crowds at Cairo's central Tahrir Square on hearing news of el-Ganzouri's appointment.

"Not only was he prime minister under Mubarak, but also part of the old regime for a total of 18 years," said protester Mohammed el-Fayoumi, 29. "Why did we have a revolution then?"

The announcement followed a meeting late Thursday between el-Ganzouri and senior military ruler Field Marshal Hussein Tantawi. Tantawi was Mubarak's defense minister of 20 years and served in the government headed by el-Ganzouri.

El-Ganzouri will replace Essam Sharaf, who resigned this week after nearly nine months in office amid deadly clashes between police and protesters calling for the military to immediately step down.

Sharaf was criticized for being weak and beholden to the generals. The television announcement said el-Ganzouri will enjoy "authority," but did not elaborate.

El-Ganzouri's appointment was likely to deepen the anger of the protesters, already seething over the military's perceived reluctance to dismantle the legacy of Mubarak's 29-year rule.

Protesters chanting, "Leave, leave!" filled up Cairo's Tahrir Square on Friday for what has been dubbed by organizers as "The Last Chance Million-Man Protest" aimed at forcing the military council to yield power.

Pro-reform leader and Nobel peace laureate Mohamed ElBaradei was mobbed by hundreds of supporters as he arrived in the square and took part in Friday prayers, leaving shortly afterward.

"He is here to support the revolutionaries," said protester Ahmed Awad, 35. "He came to see for himself the tragedy caused by the military."

Swelling crowds of demonstrators chanted, "The people want to bring down the marshal", in reference to Tantawi, who took over the reins of power from Mubarak.

The rally comes one day after the military offered an apology for the killing of nearly 40 protesters in five days of deadly clashes, mostly centered around Tahrir Square. This was the longest spate of uninterrupted violence since the 18-day uprising that toppled Mubarak on Feb. 11. The streets were relatively calm on Friday as a truce negotiated Thursday in Cairo continued to hold.

The military also has said that parliamentary elections due to start Monday will go ahead on schedule despite the unrest in Cairo and a string of other cities to the north and south of the capital.

Protesters in Cairo's Tahrir Square ? angry at the military for failing to stabilize the country, salvage the economy or bring democracy ? say they will not leave the sprawling plaza until the generals step down in favor of a civilian presidential council. Their show of resolve resembles that of the rallies which forced Mubarak to give up power.

The military has rejected calls to immediately step down, saying its claim to power is supported by the warm welcome given to troops who took over the streets from the discredited police early in the anti-Mubarak uprising as well as an overwhelming endorsement for constitutional amendments they proposed in a March referendum.

Tantawi has offered another referendum on whether his military council should step down immediately.

Such a vote, activists say, would divide the nation and likely open the door for a deal between the military and political groups, particularly the Muslim Brotherhood. Egypt's largest and best organized group, the Brotherhood is notorious for its opportunism and thirst for power. It was empowered after the fall of Mubarak, regaining legitimacy after spending nearly 60 years as an outlawed group.

Three judges are left standing on 'X Factor'

    Ray Mickshaw / Fox

"X Factor" judge Paula Abdul's final group in the competition, Lakoda Rayne, was eliminated on Wednesday.

    By Craig Berman, TODAY.com contributor

It will be a sad and lonely table at the Paula Abdul house this Thanksgiving.

She became the first judge to zero out on ?X Factor? when Lakoda Rayne got the fewest number of votes on Wednesday night. And Nicole Scherzinger?s not far behind?-- she lost Leroy Bell after the oldest singer in the competition lost a sing-off with Marcus Canty, leaving her with just one candidate left.

Well, Leroy really lost among the voters, since the judges deadlocked at 2-2. But I?ll get to that in a sec.

The Lakoda Rayne elimination was the least dramatic ever. They were paired with Drew Ryniewicz onstage, and host?Steve Jones told them that one was moving on and one had the fewest number of votes and was gone. I mean, I get that L.A. Reid didn?t like ?Skyscraper,? and that he and Simon are continuing to have their totally-not-scripted-at-all battle over her song selection, but what were the odds that she got fewer votes than a band that was and is four soloists trying to harmonize?

Despite that, Steve gave his dramatic I?m-being-paid-by-the-seconds-of-dead-air pause, making Lakoda Rayne stand there in the get-it-over-with agony before finally and mercifully sending them home to join inTENsity and the Stereo Hogzz in group oblivion. At least that means Paula gets to relax from here on out instead of doing all that pesky mentoring.

The other elimination wasn?t as obvious, but was less surprising than it might originally appear. Astro was not in the bottom two this week after nearly getting kicked off a week ago, but if his followers were ever going to be energized it would have been after Tuesday?s show. He was safe, as was Chris Rene, Josh Krajcik and all the girls.

This left Bell and Canty in danger. Bell has been fairly criticized as sounding like a session singer, while Canty was the singer who performed the worst this week, the judges? exaggerated praise notwithstanding. With L.A. and Nicole voting to save their own candidates, Paula gave her usual agonizing speech about how hard the job was, and then voted to save Bell.

That left it up to Simon, and he pulled a Paula and decided not to make a decision. Instead, he voted to save Marcus with the explicit reason that this would put the result in the hands of the American people, or at least the American people who remembered that the show was on Tuesday night this week.

Canty apparently has more to be thankful for, because the audience apparently liked him better. And it gives Simon and L.A. six of the remaining singers, so this mano-a-mano battle between the two men may soon involve higher stakes than song choices.

Were you surprised that Astro was safe, or by the two acts that were eliminated? Share your thoughts on our Facebook page!

Jury says it's deadlocked in NJ cold case from '78 (AP)

NEWARK, N.J. ? A judge is telling deadlocked jurors at the trial of a man charged with murdering five New Jersey teenagers more than 30 years ago to keep deliberating.

Lee Evans is representing himself and has pleaded not guilty.

Jurors passed a note Wednesday morning saying they couldn't reach a verdict. But the judge told them to continue.

The jury has only deliberated for about 12 hours over four days.

Prosecutors say Evans lured the youths to a vacant Newark home in 1978 by promising them work, then nailed them in a closet and set the home on fire.

The bodies of Melvin Pittman, Ernest Taylor, Alvin Turner, Randy Johnson and Michael McDowell were never found.

French riot police clash with anti-nuke protesters (AP)

VALOGNES, France ? Riot police fired tear gas at anti-nuclear protesters in a Normandy field while activists damaged a railway and delayed the departure of a train carrying recycled uranium to Germany on Wednesday.

The train finally left the depot at Valognes a bit later than scheduled, but is expected to meet protests and resistance all along its journey from a nuclear waste processing site on the English Channel to a storage site in northern Germany.

Protesters point to the disaster at Japan's Fukushima nuclear plant after a tsunami earlier this year as an urgent reason to abandon atomic power.

"Stop This Radioactive Train," read banners waved by protesters.

Some 300 demonstrators clashed with police on Wednesday in fields in the village of Lieusaint, outside Valognes, the site of the rail depot from where the train loaded with the uranium treated by French nuclear company Areva departed.

Vehicles were set aflame, and riot police responded with volleys of tear gas. It was not immediately clear if there were injuries.

Separately, someone deliberately damaged a section of train track, said Najim Chiabri of the SNCF national rail authority.

"They used a special tool to elevate the rail and they have put ballast there to stop the rail getting back into its usual position, so it creates a bump of about 5 to 10 centimeters (2 to 4 inches)," he said. He said they would use stones to stabilize the track and allow the train to pass.

Activists wore scarves on their noses and mouths to protect against the tear gas fumes. Riot police walked amid rail tracks, patrolling for trouble makers.

State-run Areva treats spent nuclear fuel from other nations, to the ire of those who contend such shipments are too dangerous for rail, sea or road.

Areva spokesman Julien Duperray said, "We respect every opinion on nuclear energy. What we do not respect and what we do condemn is the fact that some people express their opinion by, let's say, some violent actions, violent means."

Duperray said the train was expected in Gorleben, Germany, in "about three days."

In Germany, police are preparing a big security operation to protect the nuclear waste shipment, as protests are expected, despite a decision to speed up the country's exit from nuclear energy.

Chancellor Angela Merkel's government decided after Japan's nuclear disaster this year to shut all Germany's nuclear plants by 2022. But officials haven't resolved where waste should be stored permanently ? and activists argue the Gorleben site is unsafe.

French President Nicolas Sarkozy, however, reiterated his commitment to nuclear power in a speech Tuesday and said the government should continue to invest in it. France is more reliant on nuclear power than any other country, with the majority of its electricity coming from atomic reactors.

Conn. killer objects to testimony from daughter, 9

NEW HAVEN, Conn. (AP) ? A Connecticut man facing a possible death sentence for a home invasion that killed three people told a judge that he didn't want the jury to see a videotaped interview of his 9-year-old daughter, because he didn't want her to feel compelled to help "one of the most hated people in America." The judge, however, sided with his attorneys in allowing the video.

Joshua Komisarjevsky, speaking for the first time in his trial other than a taped confession, told a judge Wednesday that his daughter was coached, an allegation denied by an attorney for the girl's guardian.

"I've carefully come to the overwhelming opinion that I am not at all comfortable putting my daughter in a position wherein she may feel that she has to explain or justify herself to anyone who perceives her statements to somehow help one of the most hated people in America," Komisarjevsky said.

"She's 9 years old. Had this interview been her decision to make and she was old enough to understand that decision that would be one thing. However, that is not the case in this situation. The decision has been made for her," he said.

Komisarjevsky noted his life is on the line. He said the negative consequences to his daughter outweigh the benefits of helping to save his life.

"I will not beg for my life," he said. "I will humbly request in earnest that your honor please uphold the thoughtfully weighed decision of defendant over the wish of the defense team."

Komisarjevsky's lawyers sought his daughter's testimony, hoping to persuade New Haven Superior Court jurors to spare him the death penalty. New Haven Superior Court Judge Jon Blue agreed with the attorneys that they have the final say.

The attorney for the girl's guardian said the interview with the girl was done carefully in a nonconfrontational way.

Komisarjevsky said his daughter has been told by her guardian not to talk about him.

"It should also be considered how her memorialized words will affect her emotionally and psychologically in the future if she believes she's party to assisting the effort to put me to death," he said.

Komisarjevsky and his co-defendant, Steven Hayes, were convicted of murder in the killing of Jennifer Hawke-Petit and her two daughters at their Cheshire home. Hayes is on death row, and the jury that convicted Komisarjevsky is now taking testimony on whether he should be sentenced to death or life in prison.

Komisarjevsky also objected to planned testimony by an expert on the effect his execution would have on his daughter.

The 'shocking' UC Davis pepper-spray outrage (The Week)

New York ? Police and administrators on a California campus face the scorn of students and faculty after video of a controversial confrontation goes viral

The University of California, Davis, placed two campus police officers on leave Sunday, after they pepper sprayed protesters who were peacefully blocking a walkway in a show of support for the Occupy movement. (See the video below). The president of the University of California system said he was "appalled" by videos of the Friday incident, which went viral online. UC Davis Chancellor Linda Katehi ordered an investigation and took "full responsibility," but resisted calls for her resignation. Was there any justification for treating the demonstrators this way?

No. This is just plain wrong: There's no way to sugarcoat this "chilling" video, says Philip Kennicott at The Washington Post. Watching an officer "applying a toxic chemical to humans as if they were garden pests is shocking." Campus police say the officer wielding the spray can was just doing his job. But if this is standard procedure, the standards need to be changed.
"UC Davis pepper-spraying raises questions about role of police"
SEE MORE: Occupy's plummeting popularity: 4 theories

Sadly, the police had no better option: What happened wasn't pretty, says Jay Tea at Wizbang, but the cops really had no choice. They have a duty to uphold the law. The protesters were blocking a public sidewalk and refused to move. The cops couldn't just walk away. Was pepper spray "a great choice"? Of course not. The visuals are damning, "but I don't see how any of the other options" ? Tasers, say, or physical force ? would have been any better.
    "The least worst option"

Well, it's disturbing that this is even an option: It's scary "how common such excessive police force has been in response to the Occupy protests." says Glenn Greenwald at?Salon. We have militarized our local police in the name of fighting terrorism, and we're now living in a "police state." Our rights to free speech and assembly may be "flamboyantly guaranteed by the U.S. constitution," but "if a population becomes bullied or intimidated out of exercising rights offered on paper, those rights effectively cease to exist."

360 Panorama app now available for Android users, no gyroscope necessary (video)

Looking to capture panoramic photos on an Android handset? Well, you've certainly got plenty of options -- including, as of today, Occipital's 360 Panorama, which just hit the Android Market. Compatible with devices running Android 2.3 or above (with the exception of Honeycomb), the app offers much of the same functionality you'll find on the previously released iOS version. Just tap a button, pan your handset across any given area and watch your photo come to fruition before your very eyes. The tool also allows exposure to fluctuate as a user pans his or her device, thereby creating the potential for HDR panoramic shots during transitions from dark to bright areas. Interestingly enough, this version relies not upon an actual gyroscope, but a "simulated" one, created from motion-tracking algorithms (that's how it works on older 3GS handsets, as well). Users who already have a 360 Panorama account can still use it on their Android handsets, allowing them to upload and store all their photos in one place. Eventually, this storage system will allow for syncing across both iOS and Android hemispheres, though at the moment, it's a strictly web-based affair. Pan past the break for a brief demo video, or check out some sample shots in the gallery, below.

(AP) ? Artists used paint, ornaments and glitter to transform the human body into artwork at a festival in Venezuela, showing off designs that ranged from pure fantasy to indigenous myths.

The weekend's annual World Meeting of Body Art included body painting, tattoo art, performances and workshops. Fifty-two artists from 18 countries shared their creations at the gathering in Caracas, joining about 2,000 Venezuelans, organizers said.

Participants had their bodies painted in bright hues from orange to lime green. Vines appeared to wind down the shoulders of one woman, and a man posed as a statue with his skin painted to look like marble.

"The body is a canvas with infinite possibilities," Venezuelan artist Ivan Hernandez Rojas said. "I think it's fascinating that colors, clothing, makeup, masks, wigs, combs ... and accessories allow the human being to change from one identity to another."

The festival, which began Thursday and ended Sunday, included participants from various Latin American countries as well as others who traveled from the Japan, Luxembourg, Poland, South Africa, Australia, the United States and Austria, among other nations.

One presentation by Venezuelan David Aranguren and 11 other artists focused on the mythology of the country's Warao indigenous group, who live in the Orinoco River Delta. Actors' bodies were painted and adorned with leaves and feathers, and they played parts such as the wind and the "crocodile god."

HP Folio 13 Ultrabook official: starts at $900 with a 128GB SSD and backlit keyboard (hands-on)

And just like that, HP joined the Ultrabook party. After announcing the Folio in Australia yesterday, the company went and made it official here in the states too. And man, do we get the feeling the outfit's been watching the competition very closely: this guy starts at $900 and comes standard with a 128GB mSATA SSD and a backlit keyboard. Provided it comes close to matching its promise of nine hours of battery life, it could give the identically priced Toshiba Portege Z830 a run for its money. Not to mention, it undercuts the MacBook Air ($1,299 and up), along with the ASUS Zenbook UX31 and Lenovo IdeaPad U300s, both of which start at $1,100 with a 128GB SSD and no backlit keyboard. Good on ya, HP.

What's that, you say? You want more specs? Rounding out the list, the Folio has a 13.3-inch (1366 x 768) display, optional TPM circuitry and comes standard with a Core i5-2467M processor, 4GB of RAM, a six-cell battery and HP's CoolSense technology. Additionally, it offers a fairly robust selection of ports, including HDMI, Ethernet, USB 2.0 and 3.0, a memory card reader and a combined headphone / mic socket. The trade-off, though, is a slightly thicker chassis than what other Ultrabooks are offering: 3.3 pounds and 18mm (0.7 inches) thick. It'll be available in the US starting December 7th, but we've already managed to snag a few minutes with it, which means we've got photos, video and impressions for you to peek now. So what are you waiting for? Meet us after the break for our hands-on preview.

    Really worth $160 million?

One can debate whether Matt Kemp is the game?s best outfielder, but the truth is the Dodgers pretty much had to make him the game?s highest-paid outfielder to keep him beyond 2012. The eight-year, $160 million contract he reportedly agreed to Monday is tied for the largest ever given to an outfielder.

Manny Ramirez?s?late-2000?deal with the Red Sox, worth that same amount, had been the gold standard for outfielders. Technically, though, Kemp won?t be the game?s highest-paid outfielder, at least not right away. Carl Crawford got $142 million for seven years from the Red Sox last winter, giving him an annual salary of $20.29 million. Ryan Braun will make $21 million per year from 2016-20 under the terms of the extension he agreed to in April.

Kemp still has one year of arbitration left, so his deal rates a little better than Crawford?s. The guess is that he would have made around $16 million next year through arbitration, and if that?s the case, he?s selling his first seven free agent years for $144 million.

So, this would seem to rate as a pretty good deal for both sides. Had Kemp turned in another year like his 2011 next season, there?s no doubt that he would have topped this contract in free agency. However, this protects him if he does falter somewhat. And the truth is that he loves playing in L.A. and had no real interest in leaving.

For the Dodgers, any eight-year deal comes with substantial risk. Kemp, though, is just 27 and he?s been exceptionally durable to date.?While he?ll probably spend the second half of the deal in an outfield corner, he?s about as safe of a long-term signing as there is in the game.
