James 'Whitey' Bulger's Santa Monica Apartment A Hot Property

James 'Whitey' Bulger's apartment on Third Street in Santa Monica has become a very hot commodity among renters, reports the Associated Press. Then the landlord can set a new rent amount for the new tenant, and the rent is recontrolled at that rate." Based on reports that Bulger's neighbors were paying more than twice what he was paying on rent, Verge estimates that the new rate could be up to $2,100 per month.

After the FBI lured Bulger and Greig from their home, investigators found more than $800,000 in cash stashed in the walls, as well as over 30 firearms and several knives. FBI agents are still investigating the apartment, and it's unknown how long they will remain.

2. Moral Rights which provide a right for an artist to be identified as the creator of material such as a song, and to object to any distortion or false or misleading portrayal of their material.
3. Performers? Rights which provide various rights in performances by an artist, such as a gig. These include rights in all recordings, films or broadcasts of their performances.

The first part of this mini-series looks at copyright. Moral rights and performers? rights will be the subject of future blog posts.

What is copyright?
Copyright protection is automatically and freely available for works that are?original and that have been?recorded. The law regarding copyright is set out in the?Copyright, Designs and Patents Act 1988 (the ?CDPA?). In essence, copyright rewards individuals who have independently created a piece of work such as music or lyrics by?enabling them to control use of their work.

The CDPA sets out various categories of works that qualify for copyright protection. For?musicians, this means that distinct and separate copyright works can exist in relation to a song recorded to CD. In this example, copyright protection will apply to:

• The music of the song ?which is classified as a??musical work?.
• The lyrics of the song which is classified as a??literary work?.
• The sound recording of the song which is classified as a??sound recording?.

The fact that the CDPA provides copyright protection for sound recordings is of particular interest to?musicians as a new, clear and separate right of copyright will exist in a recording of any existing?piece of work. So, if a producer records an artist playing one of their songs then a new work has been created by the generation of that sound recording.

Artists can use this to their benefit. For example,?Squeeze recently re-recorded part of their back catalogue when?Universal refused to grant them a licence to use their original recordings. By re-recording their original works a new work was created and Squeeze own that work. This has put them back in commercial control of the songs that they originally created.

Who benefits from copyright?
The CDPA states that the person who creates the work ? the ?author? ? owns the copyright to that work. So, the artist who writes lyrics or music will own the copyright to those lyrics or music.

Often the lyrics are written by one person and the music by another. Alternatively, two or more persons could collaborate on writing a song ? both being involved in the creation of lyrics and music together. In both scenarios, the artists are called co-writers and they jointly own the work they created. In this scenario, the artists should ensure that they agree, in writing, who owns the lyrics and who owns the music. If the artists have worked together on elements of both then they should record the percentage contribution made in each area (e.g. Miss Lyricist ? 20% music, 75% lyrics and Mr. Songwriter ? 80% music and 25% lyrics).

Needless to say, there are numerous disputes between artists, producers and band members as to who wrote what. Not surprisingly, these disputes tend to surface when the disputed song becomes a hit! The most prominent recent example is that between?James Blunt and producer Lukas Burton in which Burton claims to have co-written six songs with Blunt from the Back to Bedlam album. The preponderance of such costly, prolonged and damaging disputes makes it clear that a written record of ?who owns what? should accompany the writing and recording of any material.

A special provision applies to sound recordings, where the CDPA states that the author is deemed to be the ?producer? of the sound recording. However, the CDPA goes on to define ?producer? as meaning the person who made the arrangements necessary for making the sound recording. This typically means that the party who paid for the recording will own the copyright to that recording. Artists should therefore tread carefully in this area and preferably take?legal advice. Before entering a studio as part of a demo or studio deal, be clear who will own what rights and ensure this is set out in writing and signed by the producer and studio.

How long does copyright last?
Copyright protection generally lasts for the life of the author plus 70 years from the end of the calendar year of his or her death. There are some exceptions to this. For example, for works created by co-writers copyright lasts for 70 years from the end of the calendar year in which the last known co-writer dies.

For sound recordings, copyright lasts for 50 years from the end of the calendar year in which the recording is made or published, or, if not published, played or communicated in public (where this occurs during that period).

What protection does copyright provide?
If you benefit from copyright then the CDPA prevents a person doing any of the following acts without your permission or consent:

• Copying your work.
• Issuing copies of your work to the public.
• Renting or lending your work to the public.
• Performing, showing or playing your work in public.
• Communicating your work to the public.
• Making an adaptation of your work or doing any of the acts listed above in relation to an adaptation.

For there to have been an infringement one of the listed acts must have been committed in respect of the whole or a substantial part of your work.?What is a ?substantial part? is assessed on the basis of quality rather than quantity.

In the 1934 case of?Hawkes & Son Limited v Paramount Film Service Limited the court held that a 20 second sample from a four minute recording of?Colonel Bogey was an infringement of copyright because that sample was so recognisable. Lyrics also receive protection. In?Ludlow Music Inc. v Robbie Williams and others (2000), the court found that the?Robbie Williams song??Jesus in a Camper Van? had taken the central idea from Ludlow?s??I am the Way (New York Town)?, namely that the Son of God attracted bad luck by going round saying??I am the way? and had embodied it in virtually identical words. This was of sufficient substance to amount to an infringement of copyright.

What can I do if somebody has infringed my copyright?
If somebody has infringed your copyright then there are a range of possible remedies. These include:

• Injunctions ? which can give you the power to search premises, freeze assets or prevent the sale of, say, counterfeit music.
• A court order requiring the infringer to deliver infringing copies of your work to you.
• Seizure of infringing copies and other articles.
• Forfeiture.

I have now written about 10 short reports, and I will tell that they have generated lots of income for me since I first got started with this in 2006. My most popular ones are my short reports on membership sites, affiliate marketing, and how to get started with an online business. You can learn how to write your own profit generating reports in less time than you might think.

You can decide whether to give away or sell the reports you write. I prefer to give mine away for a few different reasons. The main reason is that many more people will be able to read my reports if I make them available at no cost. These readers are also more likely to give them away to others who they know. The result is that my short report ends up in the hands of people who would otherwise never have connected with me. That is the beginning of viral marketing, especially if what you write in your report is considered good enough to share.

Keep in mind that you will want to focus on a narrow topic in your report. Instead of writing about an overall general topic, keep it niched down so that it is more specific. This will establish your credibility as a specialist in this area, and make both you and your information more sought after in the marketplace. Internet Make Marketing Money Strategy

Include some affiliate links in your report, and make sure they are appropriate to what you are writing about. This is one way that you will earn income from your writing for years to come. No more than one affiliate link per page is a good rule of thumb with this.

Also be sure that your contact information is on each page. Imagine someone printing out your report and giving it to a friend. Then, imagine that person dropping it on the floor and picking up a few pages later on, maybe even months from now. If they do not have your name, website, and other information, they will never be able to connect with you. This is simple enough to include in your footer and header.

Do the research you need in order to include as much valuable information as possible in your short report. Most of mine tend to be about ten pages long, but yours should only be as long as is necessary to provide the information your prospect would need to understand your topic. I encourage you to make a schedule for yourself so that you can create one new report each month. Decide how you will market it and see how quickly your business will grow. 1. Donate It

One of the best things to do with an old PC? Donate it to your local charity. There are many, many families out there who do not have the luxury of owning even a basic computer system. Do your part to help them get into the world of computers.

2. Trade It In

There are many computer dealers (e.g. HP) which offer trade-in promotions on computers and peripherals. Before you buy a new PC, see if the retailer can offer you any trade-in discounts. As long as your old computer is in decent condition, it can fetch some money.?Decent condition? usually refers to any Pentium-class notebook or desktop with a hard drive, monitor, keyboard, and mouse.

ScienceDaily (June 24, 2011) ? The 25.8 million Americans who have diabetes may soon be free of finger pricks and daily insulin dosing. Mayo Clinic endocrinologists Yogish Kudva, M.B.B.S., and Ananda Basu, M.B.B.S., M.D., are developing an artificial pancreas that will deliver insulin automatically and with an individualized precision never before possible.

As part of this effort, Drs. Kudva and Basu will present their latest findings on how the mundane movements of everyday life affect blood sugar to the American Diabetes Association meeting this month in San Diego.

?The effects of low-intensity physical activity, mimicking activities of daily living, measured with precise accelerometers on glucose variability in type 1 diabetes had not been examined,? says Dr. Kudva.

Among his newest findings is that even basic physical activity after meals has a profound impact on blood sugar levels for people with type 1 diabetes. ?You would expect this result, but we wanted to know to what extent this phenomena would happen in people with type 1 diabetes,? Dr. Kudva says.

Diabetics who engaged in low-grade physical activity after eating had blood sugar levels close to those of people with fully functioning pancreases. Those who remained sedentary after their meal, however, had elevated blood sugars.

The researchers plan to incorporate these findings into an artificial pancreas being developed at Mayo Clinic. The ?Closed Loop System? under development includes a blood sugar monitor, an automatic insulin pump, a set of activity monitors that attach to the body and a central processing unit.

Clinical trials of the artificial pancreases are likely to begin in November with a handful of inpatient volunteers. Study participants will follow strict diet, exercise and insulin-delivery regimens in Mayo?s Clinical Research Unit. Data will then be fed into an insulin-delivery algorithm, which mimics the body?s natural process of monitoring and responding to glucose levels in the bloodstream.

?Physical activity enhances insulin action, hence lowering blood glucose concentration,? Dr. Kudva says. ?Real-time detection of physical activity ? and modeling of its effect on glucose dynamics ? is vital to design an automatic insulin delivery system.?

Dr. Kudva and other Mayo researchers have spent nearly 15 years working on various aspects of diabetes and obesity. They are collaborating on the artificial pancreas and developing an algorithm that will afford patients the peace of mind to eliminate their daily routine of diabetes maintenance.

Dr. Basu will present findings that blood sugar levels decrease faster in the mornings in healthy adults than at dinner time, suggesting a diurnal pattern to natural insulin action. He proposes further study of this phenomenon and possible incorporation into the algorithm that drives the Closed Loop System.

The research has been funded by grants from the National Institutes of Health.

may be facing the situation of going thru personal bankruptcy. i am married and both myself and spouse work and file jointly on taxes. everything that has to do w/ the bankruptcy is in my name alone; spouse is not listed on anything. my question is this; since i alone will be filing bankruptcy do i have to include my spouses income on the paperwork? if so, i may not qualify for the chapter 7 and would have to go thru the "means test" to see if i qualify and our combined income may be to high. state we live is GA. any help or suggestions would be greatly appreciated. thx

We do drive through all the markets, and what we are finding is that absorption of new homes, meaning people moving into new homes, rose strongly in the first quarter in places like south Florida, Naples, Fort Myers, even the triad of North Carolina. Vacant new homes are down 66 percent from the peak nationwide.

In Naples and Fort Myers, 50 percent of the foreclosures that have gotten so much attention are just in two areas of that market known as Lehigh Acres and Cape Coral. If you take those out, things look a lot better.

What about prices?

Well, prices are increasing in certain submarkets and certain communities. And that is happening in markets all around the country, but only where all the stars are in alignment. In northern Virginia, a number of projects are raising prices in Loudoun and Prince William counties.

O.K., there are pockets where things are doing well. Are mortgages genuinely available?

The consumers are really challenged to get loans, and that is one of the main reasons why home sales are not higher than you would expect, given how cheap home prices are and how low interest rates are.
